Agreement to Terms
By engaging Hobbs Flooring Services for flooring installation, repair, or related services, you agree to be bound by these Terms of Service. Please read these terms carefully before requesting our services.
Services Provided
Hobbs Flooring Services provides professional flooring installation and related services, including but not limited to:
- Flooring installation (hardwood, laminate, vinyl, tile, carpet)
- Flooring replacement and repairs
- Removal of existing flooring
- Subfloor preparation and finishing
- Related flooring consultation and advisory services
All services are provided on a project basis as agreed upon between Hobbs Flooring Services and the client.
Quotes and Estimates
Quotes and estimates are provided free of charge and are valid for 30 days from the date of issuance unless otherwise specified. Estimates are based on the information provided at the time of assessment and may be subject to adjustment if project conditions differ from initial expectations.
Final project costs will be determined based on actual work completed and materials used. Any significant changes to the scope of work will be discussed and approved before proceeding.
Payment Terms
Payment for services is processed on an invoice basis. Our payment terms are as follows:
- Deposits: A deposit may be required for larger projects or material purchases, typically 25-50% of the total estimated cost
- Milestone Payments: For extensive projects, payments may be structured in milestones based on project completion phases
- Final Payment: Final payment is due upon completion of work and customer acceptance
- Payment Methods: We accept payments via Stripe online payment processing, which supports major credit cards, debit cards, and other electronic payment methods
- Late Payments: Invoices not paid within 30 days may be subject to a late fee of 1.5% per month or the maximum rate permitted by law
Project Timeline and Scheduling
Project timelines are estimated based on the scope of work and are subject to change due to unforeseen circumstances, material availability, weather conditions, or client-requested modifications. We will make every reasonable effort to complete projects within the agreed timeline.
Clients are responsible for ensuring access to the work area during scheduled times. Delays caused by lack of access may result in rescheduling fees or project timeline adjustments.
Client Responsibilities
The client agrees to:
- Provide accurate information about the project scope and site conditions
- Ensure clear access to work areas and availability of utilities (power, water) as needed
- Remove or protect personal belongings and furniture from work areas prior to service
- Secure pets and ensure a safe working environment
- Make timely decisions regarding material selections and project changes
- Inspect and approve completed work within 48 hours of project completion
Warranties and Guarantees
We stand behind the quality of our workmanship. Installation labor is warranted for a period of one year from the date of completion. This warranty covers defects in installation workmanship but does not cover:
- Normal wear and tear
- Damage caused by misuse, accidents, or improper maintenance
- Damage from water, fire, or natural disasters
- Manufacturer defects in materials (covered under manufacturer warranties)
- Changes in environmental conditions (humidity, temperature) affecting materials
Material warranties are provided by the respective manufacturers. We will assist in facilitating warranty claims when applicable.
Cancellations and Refunds
Cancellation by Client: Clients may cancel a scheduled project with at least 48 hours' notice without penalty. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee. Deposits for materials already ordered are non-refundable.
Cancellation by Hobbs Flooring Services: We reserve the right to cancel or reschedule projects due to unforeseen circumstances, inclement weather, or emergency situations. In such cases, deposits will be refunded or applied to rescheduled work.
Refunds: Refunds are provided only in cases of service non-performance by Hobbs Flooring Services. Partial refunds may be issued for partially completed work based on work performed and materials used.
Limitation of Liability
Hobbs Flooring Services' liability is limited to the total amount paid for the specific service giving rise to the claim. We are not liable for:
- Indirect, incidental, or consequential damages
- Pre-existing conditions or damage not disclosed prior to work
- Damage to hidden utilities, plumbing, or electrical systems not identified before work
- Loss of use of property during installation
- Acts of God, natural disasters, or events beyond our control
We maintain appropriate insurance coverage for our business operations. Clients are encouraged to maintain their own property insurance.
Property Damage and Insurance
While we take every precaution to protect your property, flooring installation involves inherent risks. We will make reasonable efforts to protect surrounding areas but are not responsible for:
- Minor cosmetic damage to walls, baseboards, or trim that may occur during normal installation processes
- Dust and debris inherent to flooring work (though we will clean work areas upon completion)
- Items not removed from work areas as requested
Any damage caused by our negligence will be repaired or compensated as appropriate.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through mediation before pursuing legal action. Any legal proceedings will be conducted in accordance with the laws of the jurisdiction where services were performed.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which services are performed, without regard to conflict of law principles.
Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms of Service, together with any written project agreements or quotes, constitute the entire agreement between Hobbs Flooring Services and the client regarding the services provided.
